The undersigned ("Purchaser") agrees that all purchases made by the Purchaser from the date of Purchaser’s first purchase of product from School Apparel Wholesale LLC, a Texas limited liability company, are subject to the following terms and conditions.
- • Purchaser agrees to pay any and all interest of lack of payment on its purchase, collection costs incurred to collect the account balance, including reasonable attorney's fees and court costs.
- • Purchaser shall immediately notify School Apparel Wholesale LLC of any change in ownership of the Purchaser.
- • The Purchaser hereby consents to the jurisdiction of Dallas County, Texas with a choice of law of Texas in any dispute by and between the Purchaser and School Apparel Wholesale LLC, including but not limited to lack of payment.
- • The undersigned individual is either, an officer, agent, employee, owner or principal of Purchaser and has authority to enter into this Customer Application.
- • Purchaser agrees to the above terms and conditions, and any other agreement related to the purchase of product, including but not limited to the Credit Application, Personal Guaranty and terms which may be included on any purchase order or related document, and acknowledges that this Application may be delivered and/or returned by fax and that a facsimile signature shall be deemed to be the same as an original signature for all purposes.
